TERMS OF SALE
These Terms of Sale apply to all offers made The Copper House Gallery, all orders placed by you and all agreements concluded between us in relation to the products and services offered on this website, please read them carefully.
These terms and conditions do not affect your statutory rights.
1. Acceptance of order
We reserve the right to refuse or cancel any order. Your order constitutes an offer to purchase goods from us. Our Order Acknowledgement e-mail is simply an acknowledgement that your order has been received by The Copper House Gallery. Acceptance of your order will take place only at the moment that The Copper House Gallery dispatches the goods to you. Shipment and delivery will be confirmed to you by e-mail. The Copper House Gallery is entitled not to accept your order or to withdraw from any contract, based on justified reasons. Some of the situations in which we may do so are:
- obvious errors or inaccuracies regarding the goods appearing on The Copper House Gallery site;
- your billing information is not correct or not verifiable;
- we have reason to believe that your order may be fraudulent
- we could not deliver at the address provided by you
- suspicion of credit or debit card fraud.
To help us prevent fraud, any given order may not exceed an amount of EUR 5,000 without confirmation of order with a gallery staff member
2. Eligibility to order goods
You may only purchase from The Copper House Gallery online if you are aged 16 years or over. You will need an active e-mail address and a telephone number at which you can be easily contacted.
3. Pricing and availability
3.1. The prices and availability of the goods are specified on The Copper House Gallery site. Such information is subject to change without notice.
3.2. All prices and charges on this site are in EURO. They include any VAT payable, but exclude delivery charges. Applicable delivery charges are clearly mentioned on line. In the unlikely event that the artworks are unavailable or that The Copper House Gallery needs to vary the price due to price variations, tax changes or site errors for example, The Copper House Gallery shall send you a notification by e-mail and shall allow you the opportunity to cancel your order without cost.
4. Delivery of goods
The Copper House Gallery shall deliver the goods ordered to the delivery address which you supply. All delivery times quoted are estimates only, based on availability, normal processing and delivery time. Please note that delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such. Your order may be delivered in separate parcels, or by separate carriers. We cannot deliver to PO boxes.
5. Payment options and delivery
The Copper House Gallery currently accepts the following payment methods:
- American Express
- Diners Club
It is imperative that you provide the cardholder's name as it is shown on the card. Payment is generally deducted within 24 hours following completion of your order. The processing of the payment may be done by a third party service provider. The payment service providers' terms & conditions are not a part of The Copper House Gallery 's General Terms & Conditions.
Following payment of your order, your bank statement may include a reference to the third party service provider (such as "WorldPay internet payments").
We will not ship before we have received payment. If you pay by credit or debit card, the purchase price will be deducted from your account as soon as your order has been completed online. Payments can only be processed if the billing information can be verified. We will contact you if we have any problems taking payment from the card details you provide during the order process.
6. Product description
We attempt to be as accurate as possible when describing products on the website. However, to the extent permitted by law, we do not warrant that product descriptions or other content available on the website are accurate, complete, reliable, error-free.Moreover, buying goods over the internet provides a different aesthetic experience from buying in the gallery. Colours, shapes and proportions of artworks may differ in real life from how they appear online.
7. The Copper House Gallery Guarantee: Cancellation right/Returns Policy
At The Copper House Gallery, we want you to be delighted every time you shop with us. As each print and artwork is custom made we are unable to cancel an order once it is confirmed and payment is made.
8. Returning Defective or non conforming items
You can return your prints if they are defective, faulty, described incorrectly, not of satisfactory quality or not in conformity with your order. PLEASE NOTE: The Copper House Gallery must be notified of any discrepancy with your order within 7 days from the receipt of your order (phone line 00 353 1 4784088 or email us at firstname.lastname@example.org). Upon returning an item, please indicate the reason for your return and description of the defect. Justified defective or faulty items will be replaced immediately, including the shipment charges. We wish to point out that The Copper House Gallery will not exchange or refund if the items show signs of damage not the result of a manufacturing fault. This applies to accidental, malicious and other related damage.
9. Intellectual Property, Data Rights & Trademarks
All intellectual property rights pertaining to databases, website design, text, graphics, logos, button icons, images, and all software compilations, underlying source code, software and all other material on this website belong to The Copper House Gallery and its affiliates, or their product, content and technology providers. ALL RIGHTS RESERVED. Permission is granted to electronically copy and to print in hard copy portions of this website for the sole purpose of placing an order with The Copper House Gallery or creating a profile. Any other use of materials on this website without the prior written permission of The Copper House Gallery is strictly prohibited The Copper House Gallery services referenced on this website are either trademarks or registered trademarks of The Copper House Gallery worldwide. Other brands and company names mentioned on this website may be the trademarks or registered trademarks of their respective owners. You may not publish or reproduce trademarks, trade names or service marks without the prior written permission of the owner of such trademarks or trade names.
10. Electronic communications
When you visit our site or send e-mails to us, you are communicating with us electronically. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in text form. This condition does not affect your statutory rights.
The Copper House Gallery collects information from you to, among other things, process your order. The Copper House Gallery takes reasonable care to comply with statutory requirements concerning privacy.
12. Representations and warranties - liability
The Copper House Gallery WARRANTS THAT, SUBJECT TO DIFFERENCES IN PERCEPTION AS DESCRIBED ABOVE, OUR PRODUCTS WILL HAVE THE FEATURES AND PROPERTIES AS DESCRIBED ON THIS WEBSITE. A PRODUCT IS ONLY DEEMED TO BE DEFECTIVE IF IT DOES NOT HAVE THE FEATURES AND PROPERTIES THAT WERE DESCRIBED DURING THE ORDER PROCESS. The Copper House Gallery WILL HANDLE DEFECTS IN LINE WITH ITS RETURNS POLICY.
LIMITATION OF LIABILITY:
LIABILITY IN ACCORDANCE WITH THE ABOVE CLAUSES IN THIS SECTION SHALL BE LIMITED TO THE TYPICAL, FORESEEABLE DAMAGES. TYPICAL, FORESEEABLE DAMAGES ARE LIMITED TO THE AMOUNTS YOU PAID TO The Copper House Gallery FOR THE GOODS YOU ORDERED.
Other websites may provide links or frames to this website. The Copper House Gallery is not liable for any damage resulting from any such link or frame.
Though The Copper House Gallery takes reasonable precautions to keep its website virus free, The Copper House Gallery does not accept any liability for damage resulting from a virus on or passed on through its website.
Our entire liability to you under these terms and conditions and the Returns Policy shall not exceed the price paid for the goods you have purchased through The Copper House. We will not be liable to you for any loss of revenue, profits, goodwill, for any injury to your reputation or for any losses that are not reasonably foreseeable by both of us at the time your order is accepted. We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the product.
Where you buy as a consumer, these terms and conditions will not affect your statutory rights.
13. Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
14. Governing law and jurisdiction
These terms and conditions and all transactions related to this website are governed by the laws of Ireland and are subject to the non exclusive jurisdiction of the courts of Ireland. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

15. Invalidity of any of the Terms and Conditions
These General Terms & Conditions shall be deemed severable. If for any reason, part of these General Terms and Conditions is unenforceable, the validity of the remaining General Terms and Conditions shall not be affected. We will use our reasonable endeavors to comply with any applicable statute, regulation or other ordinance as and when they come into force.
